Bus crash in Celina: who operated it changes everything

January 14, 2025

FOX 4 reported a collision involving a bus in Celina on January 14, 2025. Someone was hurt. We had no involvement in it and we are not going to speculate about the facts. What we can do is set out the legal questions an incident of this kind raises in Texas, because families dealing with one are usually working it out from scratch at the worst possible moment.

Who operated the bus changes everything

Bus cases look simple and rarely are. The identity of the operator decides who is sued, what must be proved, how much can be recovered, and — most urgently — how long there is to act.

Public agency, school district, or private company

Claims involving a transit authority, a city or another governmental unit fall under the Texas Tort Claims Act, which limits recoverable damages and requires formal written notice within a short statutory period. Many cities impose their own charter notice deadlines that are shorter still.

This is the single most important thing to understand about a public bus claim: missing the notice deadline can bar an otherwise strong case long before the two-year limitations period would have run.

Private charter, tour and shuttle operators have no such immunity, and interstate carriers are subject to the same federal safety regulations that govern commercial trucking — the same records, the same preservation questions.

Common carriers owe more

Companies that carry the public for hire are held to a heightened standard of care toward their passengers, reaching driver hiring and training, maintenance and inspection, route and schedule decisions, and passenger safety while boarding and exiting.

The multiple-claimant problem

One bus crash can injure dozens of people with claims against the same finite policy. When available coverage does not cover everyone’s losses, late claims compete for what remains. Acting early is not only about evidence; it is about position.

Dealing with the insurer

The other driver’s insurer will make contact quickly, and the call will be friendly. It is also evidence.

You are generally not obliged to give the other side a recorded statement. Questions like “how are you feeling?” and “how fast were you going?” are asked early precisely because that is when you know least — before a diagnosis, before you have seen the report, and before you have thought carefully about sequence. Any gap between that account and the medical record later becomes an inconsistency to be used.

Two other habits cause disproportionate damage: apologising at the scene, and accepting an early offer. A release signed before the medical picture is clear closes the claim permanently, including for treatment nobody has scheduled yet.

When someone does not survive

Texas limits wrongful death claims to a defined group — the surviving spouse, the children, and the parents of the person who died. They may file individually or together. Siblings cannot bring a wrongful death claim, however close they were. If no family member has filed within three months of the death, the estate’s representative may do so.

Two claims usually arise from one death. The wrongful death claim belongs to the family and covers what they lost: financial support, companionship, mental anguish, lost inheritance, household services. The survival claim belongs to the estate and covers what the person suffered before death, along with medical and funeral expenses.

Where the conduct exceeded ordinary negligence, Texas also permits exemplary damages, subject to a higher burden of proof and statutory limits.

A note on timing

None of the steps above require hiring anyone. They preserve options, and options are what disappear quietly in the first month while a family is dealing with everything else. The conversation costs nothing and commits you to nothing; what it does is tell you which clocks are running.
