Motorcycle crash on the Dallas North Tollway: why the fault percentage is the case

October 11, 2024

FOX 4 reported a motorcycle collision on the Dallas North Tollway in Dallas on October 11, 2024. Someone was killed. We had no involvement in it and we are not going to speculate about the facts. What we can do is set out the legal questions an incident of this kind raises in Texas, because families dealing with one are usually working it out from scratch at the worst possible moment.

The assumption riders start with

Ask people to picture a motorcycle crash and a striking number picture the rider causing it. That assumption reaches the claims file, and later the jury box, without anyone having to argue for it.

The reality is usually more ordinary: a driver who never saw the motorcycle, or who saw it and misjudged its closing speed. Left turns across an oncoming rider, lane changes into an occupied lane, and merges without a head check account for a large share of serious rider injuries.

Why the assumption is expensive

Texas reduces recovery by the injured person’s share of fault, and eliminates it entirely above 50 percent. Every point of blame attached to a rider is money, which is why blame-shifting is pursued as a strategy rather than offered as an opinion.

What answers it

  • Sight lines measured from the driver’s actual position, not estimated later
  • Damage patterns, which frequently contradict the account given at the scene
  • Vehicle data recording speed, throttle and braking before impact
  • Signal timing records, which are documented and obtainable
  • Independent witnesses, identified while memories are fresh
  • Reconstruction where the numbers are genuinely in dispute

Injuries that are not done developing

A rider has no crumple zone and no cage. Serious rider injuries frequently need more treatment than the first prognosis suggests, which makes an early settlement offer particularly dangerous: a signed release closes the claim for surgeries nobody has scheduled yet.

When someone does not survive

Texas limits wrongful death claims to a defined group — the surviving spouse, the children, and the parents of the person who died. They may file individually or together. Siblings cannot bring a wrongful death claim, however close they were. If no family member has filed within three months of the death, the estate’s representative may do so.

Two claims usually arise from one death. The wrongful death claim belongs to the family and covers what they lost: financial support, companionship, mental anguish, lost inheritance, household services. The survival claim belongs to the estate and covers what the person suffered before death, along with medical and funeral expenses.

Where the conduct exceeded ordinary negligence, Texas also permits exemplary damages, subject to a higher burden of proof and statutory limits.

Dealing with the insurer

The other driver’s insurer will make contact quickly, and the call will be friendly. It is also evidence.

You are generally not obliged to give the other side a recorded statement. Questions like “how are you feeling?” and “how fast were you going?” are asked early precisely because that is when you know least — before a diagnosis, before you have seen the report, and before you have thought carefully about sequence. Any gap between that account and the medical record later becomes an inconsistency to be used.

Two other habits cause disproportionate damage: apologising at the scene, and accepting an early offer. A release signed before the medical picture is clear closes the claim permanently, including for treatment nobody has scheduled yet.

What families ask first

Two questions come up in almost every call. What does this cost? Most injury matters are handled on a contingency fee — nothing upfront, and no fee unless there is a recovery. How long will it take? That depends on the severity of the injuries, how clear the liability evidence is, and whether the insurer negotiates in good faith. The one thing that should not be rushed is settling before the medical picture is clear.
